Head and neck injuries claimed in auto accident suit

John O'Leary has filed suit against Jeremiah M. Fain, alleging his head and neck were injured after a rear-end collision.

O'Leary was a passenger in a 2000 Honda Accord traveling south on Illinois Route 157 near its intersection with Parkdale Drive in Caseyville on April 16 and Fain was following the car in his 2001 Chevrolet truck, according to the complaint filed Nov. 25 in St. Clair County Circuit Court.

When the Accord stopped for traffic, Fain rear-ended the car, the suit states.

In addition to his injuries, O'Leary claims he incurred medical expenses, experienced pain and suffering, lost wages and experienced a diminution of his normal life.

Fain was negligent because he failed to keep a proper lookout, failed to stop to avoid a collision, drove too fast and rear-ended the Honda, according to the complaint.

O'Leary is seeking a judgment in excess of $50,000, plus costs.
