Machine operator sues CSX over injuries

A CSX Transportation employee has filed suit against the company, alleging he was seriously injured because of his work as a machine operator for the company.

Randolph K. Brewer claims that throughout his career at the railroad, from 1974 until 2008, he was subjected to numerous repetitive traumas while repairing railroad tracks and bridges, according to the complaint filed Nov. 21 in Madison County Circuit Court.

Because of his work, Brewer sustained severe and permanent injuries to his spine, knees and body and has suffered great pain and mental anguish, the suit states.

Brewer also claims he incurred medical expenses, will lose money and that his earning capacity has been diminished.

CSX Transportation was negligent because it failed to provide safe and suitable tools and proper equipment, failed to furnish Brewer with protective equipment and proper supervision and failed to warn Brewer of foreseeable hazardous conditions, according to the complaint.

In addition, the company negligently allowed unsafe practices to become standard, assigned Brewer work it should have known would injure him, assigned Brewer duties beyond his physical capacity, failed to provide a safe workplace, failed to provide safe work methods and failed to provide enough manpower, the suit states.

Brewer is seeking a judgment in excess of $50,000, plus costs.

He is represented by Gregory M. Tobin of Pratt and Tobin in East Alton.
