Lakins want legal malpractice set for December continued

Tom Lakin and Brad Lakin are asking that the legal malpractice case involving them and former Lakin lawyer Scott Meyer be postponed.

Chi-Yong Throckmartin of Belleville, representing the Lakins, asked July 31 that Dec. 1 trial date set by Madison County Circuit Judge Barbara Crowder be delayed.

Additional time was necessary for discovery concerning the claims of plaintiff Suzanne Krause of Tennessee, Throckmartin wrote.

Krause alleges that after she retained the Lakins and Meyer to file a personal injury suit, they let the statute of limitations expire.

The Lakins have filed a counterclaim against Meyer.

In the motion to continue the trial, Throckmartin wrote that three depositions were scheduled but did not proceed.

She wrote that mediation is scheduled for Sept. 25.

Krause missed an April 1 deadline for disclosing expert witnesses and still hasn't forwarded the disclosures, Throckmartin wrote.

Crowder set a Sept. 5 hearing on the motion.

Throckmartin and Michael Nester, both of Donovan, Rose, Nester and Joley in Belleville, represent the Lakins.

William North and Kevin McQuillan of Downers Grove represent Krause, along with George Ripplinger of Belleville.

Meyer represents himself.
