Woman sues after being struck by car

A woman who was struck by a car while sitting on a sidewalk has filed a personal injury suit in Madison County Circuit Court, alleging she sustained permanent injuries.

Gwendolyn Tebbe claims she was sitting on the sidewalk at #1 Gateway Drive in Collinsville on Aug. 5, 2006, when a vehicle driven by defendant Cindy Kaminski struck and collided with her person.

Tebbe claims Kaminski was guilty of the following negligent acts:

  • drove her vehicle at a high and dangerous rate of speed, having no regard for the pedestrian and vehicle traffic;

  • drove her vehicle without good and sufficient brakes;

  • drove the vehicle into herself even though she was in full and plain view for a sufficient length of time prior to the collision;

  • failed to keep a proper lookout for pedestrians;

  • failed to yield the right of way;

  • failed to sound her horn to give warning;

  • failed to stop her vehicle to avoid a collision; and

  • failed to keep the vehicle within a single lane of traffic.

    According to Tebbe, the collision caused severe and permanent injuries to her right foot and ankle requiring surgical repair all of which caused and will continue to cause pain and mental anguish, medical expenses and lost wages.

    Represented by Steven Dioneda of St. Louis, Tebbe is seeking a judgment in excess of $50,000, plus costs of the suit.

    The case has been assigned to Circuit Judge David Hylla.
