Man sues theater over slippery floor

7/17/2008 8:17 AM

A man who slipped on popcorn at a movie theater has filed a personal injury complaint against Kerasotes Showplace Theaters.

Gary Sannerin filed his lawsuit in Madison County Circuit Court on July 3, alleging the theater failed to exercise ordinary care in maintaining their premises.

Sanner claims he went to see a movie July 15, 2006, and when he entered the darkened theater, slipped and fell with "great force and violence, striking his right shoulder upon a theater seat thereby greatly injuring himself."

According to the complaint, Sanner was at the Kerasotes Showplace Theraters, 6633 Center Grove Road in Edwardsville, when he tripped over "the accumulation of debris and buttered popcorn."

Sanner claims the fall caused severe and permanent internal and external injuries to his head, body and limbs.

"More specifically he sustained a right shoulder rotator cuff rear (sic) with impingement; diverse vertebrae, muscles, tendons, and ligaments of his body were fractured, compressed, sprained, and torn; and by reason of said injuries, he then became, and has since been and will continue to be sick, sore, lame, and disordered," the complaint states.

Sanner also claims his various injuries caused and continues to cause great physical pain and mental anguish, medical expenses, lost wages and prevented him from attending to his usual and regular affairs, duties, employment and occupation.

Sanner is seeking a judgment in excess of $150,000, plus costs.

He is represented by Robert Gregory of East Alton.

The case has been assigned to Circuit Judge Nicholas Byron.
