Woman pushes leg off theater seat; woman in leg brace files suit

A woman whose leg was pushed off a seat in a movie theater by another patron wanting to occupy the space has filed a personal injury suit in Madison County.

Diana Coble claims Jo Anne Peek further injured her right leg which had been in a full leg brace when she allegedly "negligently came into contact with her right leg."

According to the suit filed May 23, the incident took place at the Showplace Movie Theatre in Edwardsville on Dec. 30, 2006.

Coble claims she had to extend her right leg to the seat in front of her because of her full leg brace.

She claims Peek came into the theatre and wanted to sit in the seat that she was resting her leg on.

According to Coble, Peek failed to understand that she had to have her leg in that position because of her medical condition despite being told so. Coble claims Peek negligently pushed her right leg off the chair so that she could sit in it.

Represented by Thomas Falb of Alton, Coble claims she sustained an additional injury to her right leg which caused and continues to cause pain and suffering, loss of a normal life, incur medical expenses, lost wages and a permanent disfigurement.

Her husband, Robert Coble, also is seeking damages pursuant to the Family Expense Act alleging he is paying for his wife's medical expenses.

Robert Coble also claims that he has incurred a loss of consortium.

The Cobles are seeking damages in excess $100,000, plus costs.

The case has been assigned to Circuit Judge Barbara Crowder.
