Woman alleges State Farm rescinded $3,455.92 claim payment

Mary Metcalf filed suit against State Farm Insurance Company in St. Clair County Circuit Court May 7, alleging the insurance company failed to pay her claim.

Metcalf claims she entered into a contract for insurance with State Farm on Feb. 15, 2007, and 16 days later on March 2, suffered a loss covered by the State Farm policy.

She claims State Farm conducted an investigation into her claim and agreed to pay the claim on July 3, 2007.

Metcalf's complaint does not state what type of claim she filed or what kind of damage she sustained.

According to Metcalf, State Farm rescinded the $3,455.92 payment on Aug. 23, 2007, and has since refused to make a payment.

"Plaintiff has been damaged by Defendant's refusal to honor its contract of insurance," the complaint states.

"Defendant is without reason or excuse for failure to pay Plaintiff," the complaint also states.

Represented by Peter Westhoff of Clayton, Mo., Metcalf is seeking damages in excess of $50,000, costs of the suit and reasonable attorney fees.
