Pasta House sues insurer for failing to fully pay Fairview Heights fire claim

The Pasta House Company claims Nationwide Mutual Insurance has not paid in full a fire claim which destroyed the Fairview Heights restaurant on Feb. 9, 2007.

According to the complaint filed May 7 in Madison County Circuit Court, Nationwide was under contract to provide insurance coverage to the Pasta House's Fairview Heights location from Sept. 13, 2006, through Sept. 13, 2007.

The fire totally suspended operations at that location, the breach of contract suit claims.

"The policy was in full force and effect at the time of the fire," the complaint states.

According to the Pasta House, the restaurant sustained a loss of income and additional expenses incurred with the suspension of operations in the amount of $336,031.

The restaurant claims Nationwide has refused to pay for loss of business income and continuing expenses incurred as a result of the business interruption.

"Defendant is in breach of the contract with Plaintiff by failing to fully pay Plaintiff's claim," the complaint states.

Represented by Mark Goldenberg of Edwardsville, The Pasta House is seeking damages in an amount to be proven at trial but in excess of $50,000.
