Matoesian denies Ford's motion to dismiss flaky case

Madison County Circuit Judge Andy Matoesian has denied a Ford Motor Company motion to dismiss a class action suit over flaky paint.
In a Nov. 9 order Matoesian gave Ford 28 days to answer the third amended complaint in a suit the Lakin Law Firm filed in 1999.
Lead plaintiff Daniel Schopp claims Ford failed to disclose a substantial risk that paint would delaminate and peel off cars.
Ford moved Sept. 15 to dismiss, arguing that risk of failure is inherent in any manufacturing process.
